Florida’s New Defamation Bill Wipe Out Conservative Media?

Florida’s Republican officials have presented a bill that could open the doors for journalists to be sued more easily for defamation. However, a local radio host has cautioned that the ones to truly bear the brunt of this law may be the very conservative media outlets this bill is intended to protect.

The law has received backlash for potentially endangering conservative media outlets in the state. As political consultant Trey Radel pointed out on his show, “While certain Republicans may think that they’re going to be suing and taking on The New York Times and The Washington Post, here’s the breaking news: liberal trial lawyers are going to have a field day with center-right media in the state of Florida,” Radel said.

He further stated: “Signing this into law will destroy conservative media in this state.” This has added to the growing concerns regarding the potential negative impacts of this bill.

Many have argued that this legislation could suppress our fundamental right to free speech and infringe on the First Amendment. Radel re-emphasized this point by questioning, “How do you think a conservative show host is gonna hold up in deep blue Broward County with liberal judges, because that person who is suing gets to choose where they’re going,” Radel said.

Lawyer James Lake voiced further concerns about the bill, including the potential to precipitate an onslaught of lawsuits and a presumed bias when anonymous sources are used. “This would violate the right to a jury and deny sufficient time to investigate a complex case,” Lake explained.

Critics have accused those backing the bill of reacting emotionally and thereby endangering the free expression of conservative viewpoints. Radel concluded by expressing empathy for the frustrations of Republicans but warned against the dangers this bill could pose: “They’re angry with the media. But this will open the door for liberals and liberal trial lawyers to engage in lawfare […] They care about burying the voices. They care about censoring conservative voices.”
