Former federal prosecutor Andrew McCarthy said that the recent decision by Special Counsel Jack Smith to end the prosecutions against President-elect Donald Trump is a strong indication that the cases were always politically motivated.
During an interview on “America Reports,” McCarthy explained that the decision to end the prosecutions was likely due to Trump’s victory in the presidential election on November 5th.
McCarthy pointed out that the Justice Department’s longstanding guidance states that a sitting president cannot be indicted or prosecuted. Smith then sought a superseding indictment in July of 2023 over allegations that Trump retained classified materials.
