Rep. Joe Morelle (D-N.Y.) has made a bold move in the political arena, announcing his plans to introduce a constitutional amendment that directly counters the Supreme Court’s recent ruling. This ruling provided former presidents with considerable protection against criminal prosecution for actions taken during their tenure.
The Supreme Court’s 6-3 decision, handed down on Monday, established that presidents enjoy absolute immunity for actions that are integral to their office’s core responsibilities and are ‘at least presumptively immune’ for all other official acts.
The ruling was a victory for former President Trump, as it effectively sent his federal election subversion case in Washington, D.C., back to a lower court to determine whether his January 6 actions merit protection from criminal prosecution.
In an audacious response, Morelle used social platform X to declare his intention to introduce a constitutional amendment. ‘I will introduce a constitutional amendment to reverse SCOTUS’ harmful decision and ensure that no president is above the law. This amendment will do what SCOTUS failed to do—prioritize our democracy,’ Morelle wrote.
Several Democrats have criticized the Supreme Court’s ruling, claiming it goes against the essential principle that no one, including the president, is above the law.
They argue that the Supreme Court’s interpretation contradicts the intentions of our nation’s founders.
Justice Sonia Sotomayor, who penned the dissent joined by two other liberal justices, underscored the seriousness of the ruling by stating, ‘In every use of official power, the President is now a king above the law.’
This viewpoint has been echoed by Democratic leaders who believe the ruling grants excessive immunity to presidents, thereby undermining the accountability that is crucial for a functioning democracy.
Since the Supreme Court’s judgment on a constitutional issue is virtually final and can only be changed by a constitutional amendment or a new ruling, Morelle’s proposed amendment seeks to reverse the Court’s decision and reaffirm that no president is above the law.
