SCOTUS Orders Biden To Pay Trump

Today, we’re delving into a recent Supreme Court case involving former President Donald Trump. You may have missed it, as the world is currently on fire.

The latest news is that the Supreme Court has sent a criminal case against Mr. Trump back to a lower court. That’s not all; the Court also ordered the U.S. government, better known as the Biden Administration, to reimburse Trump for his legal costs, which total $3,232.80.

The case now resides with the United States Court of Appeals for the District of Columbia. The Supreme Court’s guidance for them is to consider the case in relation to a recent decision concerning presidential immunity. This legal doctrine suggests that a president cannot be prosecuted for acts committed while in office.

Following this, the case was assigned to Judge Tanya Chutkan for further proceedings. Judge Chutkan initially disagreed with Trump’s immunity claim, contending that his four-year term as commander-in-chief didn’t place him above the law.

However, the Supreme Court recently stated that a president cannot be criminally prosecuted for acts completed as part of their official duties. This doesn’t mean presidents are above the law, though. The ruling clearly notes that while presidents cannot be prosecuted for exercising their core constitutional powers, they are subject to at least presumptive immunity from prosecution for their official acts.

Now, the task of the D. C. court is to determine whether Trump’s actions concerning the 2020 election fall under this category. This decision might make its way back to the Supreme Court, although it is not expected to occur before the November election.

It’s also noteworthy that the Supreme Court reasoned that without immunity, presidents could be subjected to endless litigation. They pointed out that “allegations of malice should not suffice to subject government officials either to the costs of trial or to the burdens of broad-reaching discovery.”
