Buckle up because we’re about to delve into a recent scandal that’s setting the political world ablaze: The Justice Department has “discovered” transcripts of President Joe Biden’s discussions with a biographer. This is the same material they previously swore they didn’t possess. These conversations are key in the criminal investigation into Biden’s mishandling of classified information before his presidency.
So, what’s the real story here? Special counsel Robert Hur’s report back in February painted Biden as “a well-meaning, elderly man with a poor memory.” This triggered a wave of Freedom of Information Act (FOIA) requests and lawsuits from news organizations and conservative groups. Their goal? To uncover information that could question Biden’s mental sharpness and fitness for office. This scrutiny, particularly after a weak debate performance against Donald Trump, played a part in Biden’s decision to not seek reelection.
But wait, there’s more. The Justice Department has been stubbornly refusing to release the audio of Biden’s interviews with Hur. They claim that making these recordings public could infringe on Biden’s privacy, lead to potential misuse like creating deepfakes, and deter other witnesses from agreeing to recorded interviews. Conveniently, Biden has claimed executive privilege over these recordings to stop House Republicans from holding Attorney General Merrick Garland in contempt of Congress for withholding them.

In a hearing last month, DOJ lawyers informed U.S. District Judge Dabney Friedrich that reviewing Biden’s audio interviews with writer Mark Zwonitzer would be an arduous task. These 70-hour long recordings contain discussions Biden had while crafting memoirs published in 2007 and 2017. The lawyers argued that scrutinizing audio for classified material is significantly more difficult than reviewing written content.
Justice Department lawyer Cameron Silverberg previously stated that there was no transcript made by the special counsel that could be confirmed for accuracy. However, on Monday night, Silverberg made a surprising turnaround, stating that Hur’s office did indeed produce transcripts of some of Biden’s conversations with Zwonitzer. These discussions reportedly contained classified information, but prosecutors were barred from pursuing charges against a sitting president and decided against it due to Biden’s memory issues and other factors.
In a shocking turn of events, the Justice Department “found” six electronic files, totaling 117 pages, that seem to be verbatim transcripts of a small portion of the Biden-Zwonitzer audio recordings. These transcripts were created by a court-reporting service for the special counsel’s office.
The Justice Department also flip-flopped on another matter. They initially resisted requests from the conservative Heritage Foundation to contact Hur about the materials he used for crucial parts of his report. However, due to the confusion over the transcripts, they reached out to another person involved in Hur’s investigation. When that individual was unavailable, they contacted Hur directly.
Hur confirmed that he relied on the Biden-Zwonitzer audio and some of Biden’s handwritten notes related to an Afghanistan memo for his report. Silverberg mentioned that he would discuss with the parties seeking access to Hur’s materials whether they would like Biden’s notes processed for potential release as well.
