It’s been nearly three long years since the infamous January 6th protests, and finally, justice is being sought. The courageous warriors at Judicial Watch have stepped up to bat for the late Air Force veteran Ashli Babbitt by launching a $30 million wrongful death suit against the federal government. This action is a direct response to the horrific shooting perpetrated by Capitol Police on that fateful day.
As reported by The Washington Examiner, the suit has been filed on behalf of Babbitt’s estate and her husband, Aaron Babbitt. They argue that the officer who pulled the trigger was “incompetent” and “dangerous,” completely failing to recognize that Babbitt posed no threat whatsoever to Congress when she entered the House speaker’s lobby.
Judicial Watch President Tom Fitton didn’t mince words during his statement at the time, stating flatly, “We just filed an important lawsuit. A $30 million dollar wrongful death action against the United States government on behalf of Ashli Babbitt’s husband and her estate. Ashli Babbit was killed for no good reason that day. Shot and killed by Lt. Michael Byrd.”
“Judicial Watch is seeking accountability from the United States government, responsible for that senseless and unjustified shooting death,” Fitton continued.
“Let’s not forget, Ashli Babbitt was the only person brutally murdered on January 6th. Our lawsuit alleges this was an unlawful shooting of an innocent woman who posed no threat. She deserves justice; she deserves accountability. And we at Judicial Watch, along with all our supporters, are proud to fight for justice for Ashli.”

The lawsuit details how after being shot by Lt.Byrd, Ashli remained conscious for minutes, enduring extreme pain and terror before finally losing consciousness. The autopsy report confirmed her death as a ‘gunshot wound to the left anterior shoulder’ with an onset interval of ‘minutes.’ Video evidence of the incident documents Ashli’s horrifying ordeal. Further autopsy details reveal that immediate death or instantaneous loss of consciousness was not expected from such a wound, and blood in Ashli’s lungs confirmed that she was still breathing after being shot. She was pronounced dead at Washington Hospital Center at 3:15 p.m., and the medical examiner ruled her death as a homicide.
In April, Judicial Watch President Tom Fitton warned about the Biden DOJ’s attempts to rig the lawsuit by moving it to a more favorable forum – another blatant attempt by Democrats to evade justice.
“The request for a change in venue is clearly influenced by Defendant’s strongest motivation for changing venue, which is to select the forum where it feels it would receive a favorable process and outcome based on adversity against January 6 participants,” said Fitton. “Defendant hopes to unfairly connect Ashli Babbitt to violence, injuries, and deaths for which she is blameless.”
On Monday Tom Fitton reported that the DOJ succeeded in their underhanded tactics to move the Ashli Babbitt case from her home district in San Diego to far-left Washington DC district. The case has been assigned to Judge Jia Cobb, an extreme leftist attorney appointed by Joe Biden himself.
This seems just like business as usual in today’s America.
