Yet again, the lackadaisical Biden administration has failed to uphold its constitutional duty to enforce federal laws that protect states, including current immigration laws. Texas Governor Greg Abbott’s relentless efforts to curb illegal border crossings, spurred by a surge of migrants, have been met with incessant legal roadblocks from the Biden administration. “The Executive Branch of the United States has a constitutional duty to enforce federal laws protecting states, including immigration laws on the books right now. President Biden has refused to enforce those laws and has even violated them,” Abbott said.
In a regrettable verdict, a federal appeals court dominated by Republican-appointed judges denied Governor Abbott’s appeal to halt legal proceedings related to the construction of a floating border barrier on the Rio Grande. This is yet another vexing obstacle for Governor Abbott in his continuous confrontations with the negligent Biden administration over border security measures.
Despite some judges expressing their reservations about the hurried trial schedule set by the lower court, they concurred that Abbott’s legal team failed to meet strict criteria necessary for halting proceedings at this juncture.
Circuit Judge Don R. Willett said, “Despite our misgivings about the district court’s decisions, we cannot say that the rigorous criteria for mandamus are fulfilled. The district court’s scheduling orders although questionable, fall shy of showing a ‘persistent disregard of the Rules of Civil Procedure’ or a pattern of noncompliance that could justify mandamus relief.”
